Non-Fungible Tokens (NFTs) exist as pieces of data found on a blockchain that link to some asset that has value. While ownership of NFTs can be transferred between accounts and users, it is rarely clear what rights are actually transferred in connection with the asset to which the underlying NFT is linked and subsequently sold. Despite these ambiguities, the creation, sale, and transfer of NFTs continues to grow worldwide. This presentation will consider the nature of an NFT, the ownership rights attached to an NFT and the subject asset, and strategies for protecting and enforcing those ownership rights. Our speakers, Dan Tysver (USA), José Roberto Herrera (Colombia), and Pierluigi Villani (EU), will provide perspectives on this topic from jurisdictions across the globe.
