Ideal candidate should have a base knowledge of IP law and privacy law. Candidate must have active California Bar membership. Opportunity to work with startup and emerging growth technology companies in a variety of industries and with international consumer products brands. The successful candidate will enjoy working in a dynamic and collegial environment, for a law firm with robust practices in corporate, public securities, M&A, entertainment, IP, brand protection, privacy and data security and business litigation.

I have never kept my distaste for DNA collection companies a secret, but am flabbergasted by 23andMe's attempts to blame its users for their hack. Let me make one thing very clear, if you are a company that is built on the collection of sensitive personal information, you better require 2FA or MFA. If you are a user that gave 23andMe your data (or any similar provider) consider requesting deletion of that data to prevent future issues. For 23andMe, you can request deletion in the “23andMe Data” section of your Account Settings.

This one hits a little differently. I am genuinely honored and proud. IP is and has been my love and will always have a special place in my heart. As I said in my interview for this piece, "It’s a very creative process and I think that’s what makes it really fun." A reminder that we should love what we do. It should be fun. Maybe not every day or every piece, but I love what I do. And that is all I could have asked for when I became a lawyer. (PS, it is important to note, this was not a linear journey. Ask me to tell you the story the next time you see me.)

Hot off the press, the Texas Senate just passed the Texas Data Privacy & Security Act, sending it back to the House for a final vote. The TDPSA is a comprehensive privacy law that will dramatically change how personal data is regulated in Texas. For the uninitiated, this means: - New privacy rights for Texans (e.g., rights to access and delete data) - Significant compliance obligations for in-scope businesses - Fines of up to $7,500 per violation (with a 30-day cure period) For privacy/compliance pros, the TDPSA is largely based on the VCDPA, but is unique in ways that will make this arguably the most impactful state privacy law since the CCPA. Most notably, rather than basing applicability on revenue or scale of data processing, the TDPSA only applies to companies that process personal data of Texas consumers and do not qualify as a "small business" as defined by the US Small Business Administration. The thing is, the SBA does not have a single, generally applicable definition of "small business." It's an extremely variable and context-specific determination, and can change depending on the circumstances under which a company is trying to claim small business status, the industry of that company, etc. A company’s small business status could also be undermined by its affiliations (corporate or otherwise) because of the SBA’s complicated and aggressive “affiliation” rules - e.g., a tiny start-up could potentially lose its small business status as soon as it receives a substantial investment from a private equity firm. The TDPSA still has to clear a few hurdles before it becomes law, but it is well on its way. Stay tuned!
