Buckle up! The U.S. Copyright Office is going to be dropping some exciting material. They just announced their AI Initiative in 2024… here’s what to expect!
In 2023, the USCO launched its AI Initative, and now it’s preparing to release a number of updates that, in combination, provide a robust report on the current and future states of #copyright law. The report, the USCO notes, will be “published in several sections, analyzing the impact of AI on copyright and making recommendations about any legislative or regulatory action.”

Report: a first section that covers the topic of digital replicas, or “the use of AI to digitally replicate human artists’ appearances, voices, or other aspects of their identities.”
This is going to be particularly interesting as Tennessee just passed the ELVIS Act which provides additional protections of NIL rights in the age of #generativeAI and synthetic content.

Report: the second section of the report will be focused on the extent to which, if at all, works that incorporate AI-generated materials will be copyrightable.
On this topic, the USCO shares that at some point they will be publishing a public notice requesting comments on updates to the Compendium of U.S. Copyright Office Practices (often referred to simply as the “Compendium”) to provide additional guidance and examples around registration of works that contain AI-generated materials. I’ll be most curious as to what new guidance or examples will be included that hasn’t already been shared.

Report: the USCO indicates that additional sections of the report are coming, potentially in the fall, with the full report being finalized by the end of the fiscal year. They share that additional sections will focus on the questions surrounding the training of AI models while using copyrighted works (definitely a 🔥 topic) as well as licensing and liability within the generative AI space.

The USCO also shares that it “has brought together a group of government and academic economists to discuss the economic aspects of the intersection of copyright and AI.”
No specifics were provided, but they did note that a research agenda will be published later this year.
